For years, Plaintiffs pursuing dram shop actions against bars and restaurants were able to pursue their claims under both the common and statutory law. In the matter of Torres v. JAI Dining Services, the Arizona Supreme Court held that Arizona liquor liability statutes abrogated the common law dram shop action and thus, a Plaintiff can no longer pursue their claims under both theories. Ms. Barrett will discuss the current state of the law and the impact on dram shop litigation.

Dominique Barrett is a partner in the Scottsdale, Arizona office of QPWB. Ms. Barrett is a trial attorney with over 25 years of litigation experience focused on the defense of physicians, nursing homes, assisted living facilities, bars and restaurants and other healthcare and long-term care professionals and organizations. Her practice includes the areas of wrongful death, medical malpractice, products liability, dram shop actions, liquor liability defense, premises liability and automobile accidents. Ms. Barrett has extensive first chair jury trial experience in Arizona, Colorado and New Mexico.

Ms. Barrett received her Juris Doctor from the University of Denver College of Law in 1992 and Bachelor of Science in Business Administration from the University of Arizona in 1988.
